Welcome to Eworm. These Terms of Service ("Terms") govern your use of the Eworm website, online store, products, and related services (collectively, the "Services").

By accessing our website, placing an order, or using any Eworm product, you agree to these Terms. If you do not agree, please do not use our Services.

1. Acceptance of Terms

By visiting Eworm or purchasing from us, you acknowledge that you have read, understood, and agree to be bound by these Terms.

Eworm reserves the right to update, modify, or replace these Terms at any time without prior notice. Continued use of our Services following any changes constitutes acceptance of those changes.

2. Products and Pricing

All product descriptions, specifications, images, availability, and pricing are subject to change without notice.

While Eworm strives to ensure all information is accurate, we do not warrant that product descriptions, images, or other content are free from errors.

Products may vary slightly from images due to manufacturer revisions, display settings, or production changes.

Compatibility Notice

Not all products sold by Eworm are compatible with every eBike, eMoto, controller, battery, motor, or wiring configuration.

Customers are responsible for confirming compatibility before purchase. Eworm is not liable for products that are incompatible with a customer's specific setup.

Estimated delivery dates and stock availability are provided for guidance only and are not guaranteed.

3. Orders and Payment

Orders are processed only after payment has been received and verified.

Eworm reserves the right to cancel, refuse, or limit any order at our discretion, including orders affected by pricing errors, stock discrepancies, or suspected fraudulent activity.

Customers must ensure all information provided at checkout is accurate and complete.

4. Shipping and Delivery

Shipping times are estimates only and may vary due to courier delays, customs processing, weather events, or other circumstances beyond our control.

Some products may be made-to-order or require additional processing time before dispatch.

Once an order has been shipped, responsibility for delivery rests with the courier service.

Eworm is not responsible for:

Delayed deliveries
Lost or stolen parcels
Customs delays
Damage occurring during transit

Customers are responsible for providing a correct shipping address.

5. Returns, Refunds, and Cancellations

Orders may be cancelled within 24 hours of purchase provided they have not been shipped.

Any damaged, defective, or incorrect items must be reported within 48 hours of delivery with clear photographic evidence.

Returns may only be accepted if approved by Eworm.

We do not accept returns on:

Used products
Installed products
Modified products
Custom-made items
Clearance or sale items

Approved refunds will be processed to the original payment method within 7–10 business days.

Return shipping costs are the responsibility of the customer unless otherwise agreed in writing.

6. Product Use and Installation

Eworm products are intended for use by knowledgeable individuals on compatible systems.

Customers are responsible for ensuring proper installation and use of all products.

Improper installation, misuse, modification, or alteration of products may result in damage, injury, fire, or equipment failure.

Eworm is not responsible for any loss, damage, or injury arising from:

Incorrect installation
Wiring errors
Product modification
Use on incompatible systems
Electrical faults or short circuits
Failure to follow instructions

If you are unsure about installation, consult a qualified eBike or electrical technician.

7. Safety Disclaimer

eBike and eMoto products may affect the performance, speed, power output, and legal classification of a vehicle.

By purchasing from Eworm, you accept full responsibility for ensuring your vehicle remains safe and compliant with applicable Australian laws and regulations.

Eworm does not guarantee that any product will be legal for road use in your state, territory, or country.

Always wear appropriate safety equipment and ride responsibly.

8. Warranty Disclaimer

Unless otherwise stated, all products are supplied "as is" and "as available."

To the maximum extent permitted by law, Eworm disclaims all warranties, whether express or implied, including but not limited to:

Merchantability
Fitness for a particular purpose
Compatibility with third-party systems

Warranty claims may be denied where products have been modified, misused, improperly installed, or damaged through user error.

Nothing in these Terms excludes rights available under the Australian Consumer Law.

9. Limitation of Liability

To the maximum extent permitted by law, Eworm, its owners, employees, affiliates, and suppliers shall not be liable for any indirect, incidental, consequential, special, or punitive damages.

This includes, but is not limited to:

Property damage
Battery damage
Fire
Electrical failure
Personal injury
Loss of income
Loss of business

Any liability arising from a claim relating to a product shall not exceed the purchase price paid for that product.

10. Intellectual Property

All content displayed on the Eworm website, including logos, branding, text, images, graphics, product listings, and designs, is the exclusive property of Eworm.

No content may be copied, reproduced, distributed, modified, or used without prior written permission.

Unauthorized use may result in legal action.

11. Privacy

Eworm collects customer information solely for the purposes of processing orders, providing support, improving services, and complying with legal obligations.

We do not sell customer data to third parties.

Information may be shared with payment processors, shipping providers, or authorities where required by law.

12. Indemnification

By purchasing or using Eworm products, you agree to indemnify and hold harmless Eworm, its owners, employees, affiliates, and suppliers from any claims, damages, losses, costs, or legal expenses arising from:

Injuries or damages caused by your use of our products

13. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any rights or remedies available under the Competition and Consumer Act 2010 (Cth) or Australian Consumer Law.

Consumers may be entitled to certain guarantees that cannot be excluded by law.
